PRESS R= ELEASE - UPDATED
DOCKET NO. 051A-2011-02 - CONSENT ORDER

=0A

The Ar= kansas Oil and Gas Commission (=E2=80=9CAOGC=E2=80=9D) unanimously voted to= approve an emergency order sought by the Director, Lawrence E. Bengal, to = immediately cease all injection operations in the Chesapeake Operating Inc.= (=E2=80=9CChesapeake=E2=80=9D) SRE 8-12 1-17 SWD Well in Sec. 17-T8N-R12W,= and the Clarita Operating LLC (=E2=80=9CClarita=E2=80=9D) Wayne L. Edgmon = No. 1 SWD Well in Sec. 6-T7N-R12W, both in Faulkner County. This emergency = order is valid through the last day of the regularly scheduled AOGC hearing= beginning on Marcy 29, 2011.

=0A

The Staff of the AOGC and the Arkans= as Geological Survey (=E2=80=9CAGS=E2=80=9D) have found no correlation betw= een seismic activity and the drilling, or completion (including fracture st= imulation) of production wells. However, it is the opinion of the Staff of = the AOGC, based upon research by the AGS and the Center for Earthquake and = Information (=E2=80=9CCERI=E2=80=9D), that there is circumstantial evidence= which supports a temporary shut-down of the two above referenced disposal = wells. An interpretation of the preliminary information obtained in accorda= nce with AOGC Order No. 602A-2010-12 shows a potential correlation between = injection operations in one, or both, of these two disposal wells and the s= eismic activity in the area.

=0A

The Director requested an emergency o= rder due to the apparent existence of a previously unknown or unmapped faul= t highlighted by the recent seismic activity, as interpreted by CERI, upon = which both of these two disposal wells are located in, or nearby.

=0A

= Chesapeake and Clarita agreed to cease all injection operations in the two = subject disposal wells, without agreeing with the position that there may b= e a potential correlation between operation of these two disposal wells and= seismic activity in the area. The Director will file an application reques= ting an extension of the cessation order, including a presentation of evide= nce of the potential correlation between injection operations in the subjec= t disposal wells and seismic activity in the area. Such application is sche= duled to be presented at the next AOGC hearing beginning on March 29, 2011.= Both Chesapeake and Clarita will have the opportunity to present evidence = at the hearing. For information please contact the Arkansas Oil and Gas Com= mission at 501-683-5814.
